New legislation for sexual harassment in the workplace
17 March, 2023
Karen Maher recently spoke with ABC Radio about new legislation that has strengthened the framework addressing sexual harassment in Australian workplaces.
Prior to 6 March 2023, individuals who experienced workplace sexual harassment were required to lodge an unlawful discrimination complaint through the Australian Human Rights Commission.
Under the updated legislation, the Fair Work Commission can now also receive complaints relating to unlawful sexual harassment. This change expands the avenues available for workers seeking support and accountability.
Importantly, complaints can now be initiated not only by individuals but also by third parties such as unions.
This provides workers with an additional pathway to pursue redress, including the potential for compensation. For employers, the introduction of stronger penalties and the risk of costly legal proceedings creates a clear incentive to actively prevent sexual harassment in the workplace.
As Karen explained, “For too long we’ve been putting the cart before the horse, with a system that addresses sexual harassment after it has occurred. Now, at last, the onus is on the employer to do all they can to prevent it.”
